TikTok Ban update November 2024

In September 2024, a critical chapter unfolded for TikTok's future in the United States. On September 15th, TikTok and eight U.S.-based creators presented oral arguments before a federal appeals court in Washington, D.C., challenging a looming ban on the platform.

The ban, set to take effect on January 19, 2025, stems from a law passed by Congress in April, which TikTok and the creators argue is unconstitutional. The hearing involved a panel of three federal judges questioning both TikTok and the Department of Justice (DOJ) on the law’s requirement that TikTok divest from its Chinese parent company, ByteDance, or face prohibition in the U.S.



TikTok and its supporters contended that the ban violates First Amendment rights, both for the platform and its users. They also criticized the government's reliance on heavily redacted documents, alleging that this lack of transparency prevents TikTok from mounting an adequate defense. Furthermore, TikTok emphasized that U.S. user data is stored on Oracle-owned servers within the United States, with no access provided to ByteDance or Chinese authorities. The company dismissed national security concerns as unfounded and unsupported by concrete evidence.

Conversely, the U.S. government argued that ByteDance’s ownership of TikTok inherently poses a national security risk due to potential influence from the Chinese Communist Party. They asserted that Congress holds the authority to address such threats preemptively. The DOJ underscored concerns about possible misuse of U.S. user data or manipulation of content to sway public opinion.


The public was able to follow the hearing via a livestream on the D.C. Appeals Court's YouTube channel. The judges appeared skeptical of arguments from both sides, grappling with the legal complexities surrounding free speech, foreign ownership, and national security. Their ruling, expected by December 6, 2024, will determine TikTok’s fate. Regardless of the outcome, appeals to a broader judicial panel or the Supreme Court are anticipated.
